Sexual Offences Against Children Under POCSO Act

Introduction 

The Protection of Children from Sexual Offences Act (POCSO) of 2012 establishes comprehensive legal protections for children against sexual abuse. Chapter II specifically defines and categorizes sexual offenses against children and their corresponding punishments. 

What are the Key Provisions of Chapter II - Sexual Offences Against Children under POCSO Act? 

  • Penetrative Sexual Assault (Sections 3-4): 
    • Definition (Section 3): Penetrative sexual assault occurs when a person: 
      • Penetrates a child's body with their penis. 
      • Inserts any object or body part into a child's body. 
      • Manipulates a child's body to cause penetration. 
      • Applies their mouth to a child's intimate parts or forces such acts. 
    • Punishment (Section 4): Imprisonment of not less than seven years, potentially extending to life imprisonment, plus a fine. 
  • Aggravated Penetrative Sexual Assault (Sections 5-6): 
    • Definition (Section 5): This offence occurs under aggravating circumstances, including when: 
      • The perpetrator holds a position of authority (police, armed forces, public servant). 
      • The perpetrator works in custodial institutions, hospitals, or educational institutions. 
      • Gang assault occurs. 
      • Weapons or harmful substances are used. 
      • The assault causes serious physical or mental harm. 
      • The victim is under twelve years. 
      • The perpetrator is a relative or guardian. 
      • The assault occurs during communal violence. 
    • Punishment (Section 6): Rigorous imprisonment of not less than ten years, potentially extending to life imprisonment, plus a fine. 
  • Sexual Assault (Sections 7-8): 
    • Definition (Section 7): Sexual assault involves touching intimate parts of a child with sexual intent, without penetration. 
    • Punishment (Section 8): Imprisonment of not less than three years, which may extend to five years, plus a fine. 
  • Aggravated Sexual Assault (Sections 9-10): 
    • Definition (Section 9): Similar to aggravated penetrative sexual assault but without penetration, occurring under the same aggravating circumstances. 
    • Punishment (Section 10): Imprisonment of not less than five years, which may extend to seven years, plus a fine. 
  • Sexual Harassment (Sections 11-12): 
    • Definition (Section 11): Sexual harassment includes: 
      • Making inappropriate sounds, gestures, or showing objects with sexual intent. 
      • Making a child exhibit their body. 
      • Showing pornographic content. 
      • Stalking or repeatedly contacting a child. 
      • Threatening to use depictions of the child in sexual contexts. 
      • Enticing a child for pornographic purposes 
    • Punishment (Section 12): Imprisonment up to three years, plus a fine.

Chapter II of the POCSO Act creates a tiered structure of offenses based on the nature and severity of sexual abuse against children.
