Who is Justice Vikram Nath?

Justice Vikram Nath was born on 24th September 1962. Notably, Justice Nath made history as the first Chief Justice of a High Court in India to live stream court proceedings on a YouTube channel. He is a law graduate from the University of Lucknow.

How was the Career Journey of Justice Vikram Nath?

  • Justice Vikram was enrolled with the Bar Council of Uttar Pradesh on 30th March 1987.
  • His acumen and dedication to the law earned him elevation as an Additional Judge of the Allahabad High Court on 24th September 2004.
  • He took oath as Judge of the Allahabad High Court on 27th February 2006.
  • He was later elevated as Chief Justice of the Gujarat High Court on 10th September 2019.
  • Further, he was elevated as a Judge of the Supreme Court of India on 31st August 2021, and he will be retiring on 23rd September 2027.

What are the Notable Judgments of Justice Vikram Nath?

  • Loknath Chakrapanidas Mahant v. State of Gujarat (2021):
    • In this case, the Gujarat High Court struck down the Gujarat Cooperative Societies (Amendment) Act, 2019 as unconstitutional and violative of Article 14 of the Constitution of India, 1950.
    • The bench also consisting of Justice Vikram Nath held that the exclusion of cooperative sugar factories from the list of specified societies for conducting elections was discriminatory and arbitrary, without any reasonable object or public interest.
  • Barun Chandra Thakur v. Master Bholu (2022):
    • The Supreme Court held that the consideration that “mental capacity and the ability to understand the consequences of the offence are one and the same” is a grave error.
    • The bench also consisting of Justice Vikram Nath held the Juvenile Justice Board and Children's Court did not follow proper procedure in conducting the preliminary assessment to determine if the juvenile should be tried as an adult.
    • The Court remanded the matter back to the Board for fresh consideration after rectifying procedural defects.
  • Ramathal v. K. Rajamani (2023):
    • The bench also consisting of Justice Vikram Nath noted that “Law is well settled that where it is alleged that the document of sale is void, then no cancellation would be necessary and such a document can be ignored under law”.
